Terms of Service

Last updated · 2026-05-18

1. The Service

“NEXTFRAME Cinema Master Pro” (電影大師 Pro; the “Service”) is operated by NEXTFRAME AI STUDIO LLC (a limited liability company organized under the laws of the State of Wyoming, USA — “we”, “us”, “our”), an AI-assisted film pre-production platform built for independent creators. Features include script generation, shot breakdown, character and scene generation, and short-form video generation. The Service uses third-party AI model providers (see Privacy Policy §5) to deliver generations; we act as the integration and workflow layer.

2. BETA Notice

The Service is currently in BETA and is invite-only. During BETA, features, pricing, and availability may change. We will make reasonable efforts to maintain stable service, but for BETA-period outages or content loss we accept no liability beyond what is set out elsewhere in these Terms.

3. Eligibility

You must be at least 13 years old (the floor set by the US Children's Online Privacy Protection Act, COPPA) to use the free features of the Service. You must be at least 18 and have full legal capacity to subscribe to any paid plan or otherwise transact. Users aged 13–17 require the consent of a parent or legal guardian. We reserve the right to request proof of age.

We do not accept registrations from persons located in countries on the US OFAC sanctions list, or other regions listed under US Department of Commerce export-control regimes (EAR / ITAR). If your region is not supported by our payment or AI service partners, you may not be able to complete signup or checkout.

Keep your login credentials secure. Accounts are personal — no transfer, sharing, or rental. If you suspect unauthorized access, contact ai@next-frame.aiimmediately.

4. Acceptable Use

You may not use the Service to:

  • Generate content that infringes IP, defames, harasses, or constitutes hate speech or illegal material
  • Generate likenesses of real people without their consent, or deepfakes
  • Generate child sexual abuse material (CSAM) or any explicit content involving minors (categorically prohibited; we will report to authorities)
  • Generate content for fraud, disinformation, or election manipulation
  • Generate content related to the development of weapons or explosives
  • Circumvent rate limits, billing, or content-safety mechanisms
  • Reverse-engineer, scrape, or run automated bulk requests against the Service
  • Resell the Service's output capability as a competing third-party service

Violation results in immediate account suspension; credits already debited are not refunded. Serious unlawful conduct will be reported to the appropriate authorities. If your violation causes loss to us or to a third party, you must indemnify us under §10.

4-1. Invitation-only features and content removal

Some accounts may, after individual review by us, use a generation mode with a looser review threshold ("Relaxed Moderation"). It is enabled only by our admins on individual application and may be withdrawn at any time; before first use, the user must accept each usage condition. Content made with it is for the user's personal use only and may not be published, shared, or placed in any public showcase of the Service.

In any mode, you may not create: (1) sexual content involving minors or people who appear to be minors; (2) sexual or nude content made from a real person's image without that person's consent; (3) content depicting sexual violence, non-consensual situations, or bestiality. We may review content by automated and manual means, remove violating content, suspend accounts, and report to the authorities as the law requires.

Anyone who finds a fake sexual depiction of themselves, an intimate image shared without consent, or other content that violates their rights may submit a content removal request (no sign-in needed). We act within 48 hours of receiving a request and make reasonable efforts to remove identical copies too.

5. Third-Party AI Models

Generations are produced by third-party AI model providers (including Google, Anthropic, OpenAI, and ByteDance) accessed via their APIs. By using the Service, you also agree to the terms of those providers, which may change. We will make reasonable efforts to reflect material changes. Output quality, accuracy, availability, and fitness for any particular purpose are determined by each model provider; we do not accept liability for the model itself.

6. User Content & Intellectual Property

You retain all copyright in the content you generate through the Service. You grant us a license to process that content only as necessary to provide and improve the Service, including:

  • Storing it with our cloud service partners (see Privacy Policy §5)
  • Transmitting it to AI model providers to execute generation requests
  • Displaying it in-product (thumbnails, previews, share links)

We do not use your content to train AI models, and we do not license your content to any third party for training. Content that has been sent to a model provider for processing is subject to that provider's own retention policy.

You represent and warrant that you hold the rights necessary for any material you upload (including real-person photographs, reference images, and commercial logos). If a third party asserts a claim arising from your uploaded material, you accept full legal responsibility and will indemnify us under §10.

You may delete your content at any time. We will purge it from operational databases within 30 days and from backups within 90 days. Content you have shared publicly (via share-link) remains accessible until you revoke the link.

7. Payment & Subscription

Subscriptions bill monthly in US Dollars (USD). Monthly credits reset at the start of each billing cycle and do not roll over. One-off credit packs do not expire while the subscription is active. Credits are auto-refunded when a generation fails terminally.

See the full Refund Policy for details.

If your payment method is declined, we will retry. After 14 days of continuous failure, the subscription downgrades to Free; previously generated content remains accessible but no new content can be produced.

8. Suspension & Termination

You may cancel your subscription at any time from /account/billing . Current-period fees are non-refundable; the Service downgrades to Free at the end of the current period. To delete your account entirely, email ai@next-frame.ai.

We reserve the right to suspend or terminate an account for: violation of these Terms; payment failure; legal or regulatory order; or use we reasonably determine to be unduly harmful to other users or to the Service. Material changes will be notified by email at least 30 days in advance. If termination leaves a paid but unused subscription period, we will refund the unused portion pro rata.

9. Disclaimers & Limitation of Liability

THE SERVICE IS PROVIDED “AS-IS” AND “AS-AVAILABLE.” WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FIT FOR YOUR PARTICULAR PURPOSE. AI-GENERATED CONTENT MAY BE INACCURATE, DISTORTED, BIASED, OR INAPPROPRIATE; YOU MUST INDEPENDENTLY VERIFY ITS RELIABILITY AND SUITABILITY, ESPECIALLY BEFORE COMMERCIAL OR PUBLIC USE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR AGGREGATE LIABILITY TO YOU IS CAPPED AT THE TOTAL SUBSCRIPTION FEES ACTUALLY PAID BY YOU TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST GOODWILL, OR LOST DATA.

10. Indemnification

You agree to indemnify, defend, and hold us harmless from any third-party claim, action, loss, or expense (including reasonable attorneys' fees) arising from: (a) your use of the Service in violation of these Terms; (b) material you uploaded that infringes a third party's rights; or (c) content you generated through the Service that violates the law.

11. Force Majeure

We are not liable for any failure to perform under these Terms caused by events beyond our reasonable control, including war, natural disaster, pandemic, large-scale internet or power outage, governmental order, or sustained failure of a third-party service provider.

12. Governing Law

These Terms are governed by the laws of the State of Wyoming, USA, and applicable US federal law, without giving effect to conflict-of-laws principles. All disputes, claims, and matters of interpretation relating to the Service or these Terms shall be governed by Wyoming and US federal law.

13. Dispute Resolution: Arbitration & Class-Action Waiver

PLEASE READ CAREFULLY — THIS SECTION AFFECTS YOUR LEGAL RIGHTS.

13.1 Binding Arbitration. Except as set out below, any dispute, claim, or cause of action between you and us (whether grounded in contract, tort, statute, or any other legal theory) shall be resolved by individual, final, and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The seat of arbitration is Cheyenne, Wyoming, USA, and proceedings may be held by remote video. Any award may be entered as a judgment in any court of competent jurisdiction.

13.2 Exceptions. The following are NOT subject to mandatory arbitration and may be filed in court:

  • Small-claims actions filed in the small claims court of your residence or ours, up to that court's jurisdictional limit
  • Intellectual-property disputes (copyright, trademark, trade secrets) — either party may file in federal court in Wyoming or California
  • Actions seeking injunctive or equitable relief to stop an ongoing violation

13.3 Class-Action Waiver. You agree to bring any claim against us only in your individual capacity, and not as a plaintiff or class member in any purported class, mass, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of class proceeding. If this waiver is found unenforceable, the unenforceable portion is severed back to court — the remaining arbitration provisions remain in effect.

13.4 30-Day Opt-Out. You may opt out of §§13.1–13.3 by sending an email to ai@next-frame.ai with the subject “Arbitration Opt-Out” within 30 days of your first acceptance of these Terms, including the email address registered to your account. If you opt out, disputes between us instead proceed under §12 in the courts of Laramie County, Wyoming, or the US District Court for the District of Wyoming. Opting out has no effect on the rest of these Terms.

14. Copyright Infringement Notice & Takedown (DMCA)

We respect the rights of copyright owners and provide a notice-and-takedown procedure under 17 U.S.C. § 512. If you believe material on the Service infringes your copyright, submit a written notice to our Designated Agent:

  3. Identification of the allegedly infringing material on the Service, with enough detail (e.g., URL) for us to locate it.
  4. Your contact information (name, address, phone, email).
  5. A statement made in good faith that the use is not authorized by the copyright owner, its agent, or the law; and a statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

We terminate the accounts of repeat infringers in accordance with § 512(i).

15. Changes to These Terms

We may update these Terms from time to time. Material changes (affecting payment, acceptable use, liability, etc.) will be notified by email or in-product banner at least 30 days in advance. Non-material changes (e.g., typo fixes) take effect immediately; continued use of the Service constitutes acceptance of the new Terms.

16. Entire Agreement & Severability

These Terms constitute the entire agreement between you and us. If any provision is found invalid or unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right is not a waiver of that right.
